PRIVACY POLICY

1. INTRODUCTION

Kuttura LLC ("Kuttura," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, share, and protect personal information when you visit our websites, use our applications, products, and services, or communicate with us (together, the "Services"). By using the Services, you agree to the practices described in this Policy. Project Oozlefinch and the Visual Aircraft Catalog & Recognition application ("VACR") are Services of Kuttura LLC.

2. INFORMATION WE COLLECT

We collect the following categories of information:

• Contact Information: name, email address, mailing address, and phone number, when you give them to us.
• Account and Usage Information: username, a one-way hash of your password (not the password itself), license tier, account status, seat and login records, preferences, feedback, and communications with us.
• Device and Technical Information: IP address, browser type, device type, operating system, and similar data collected automatically when you use the Services.
• Subscription and Transaction Information: for a paid Expert license, the plan you chose, whether renewal is automatic, the date the subscription started, the date the current period ends, and whether a payment succeeded or failed. Payments are processed by Stripe. Kuttura LLC does not receive or store full payment card numbers, card security codes, or bank account numbers. If a subscription ends, we keep your username, name, and email, and we keep the Stripe customer and the saved card (brand and last four digits only) so the same card can be used if you subscribe again.
• Scan Information: a photograph or frame you submit for identification, and a location hint if you have turned location on for that scan. We use that submission to return an identification. We do not keep a photo library of scans on our servers.
• Cookies and Analytics Data: information collected through cookies and similar technologies, as described in Section 6.

3. HOW WE COLLECT INFORMATION

We collect information (a) directly from you when you create an account, subscribe, submit a scan, submit feedback, or contact us; (b) automatically when you use the Services; and (c) from service providers who help us operate the Services, including payment status returned by Stripe.

4. HOW WE USE INFORMATION

We use personal information to provide, operate, and maintain the Services; create and administer accounts; process subscriptions and renewals; communicate with you, including service notices and responses to inquiries; improve, test, and develop our products and Services; secure the Services and prevent fraud or misuse; and comply with legal obligations.

Expert is a recurring subscription at the price shown in the app, billed monthly or yearly. Automatic renewal is on unless you turn it off. If a renewal charge fails, we try again the next day and, if that fails, one more time the following day. If the charge still fails, or if you turn off automatic renewal and the paid period ends, the subscription expires, your license returns to Novice, and we keep the expiration date on your account so the app can show it to you.

We may use synthetic consciousness, as described in Section 5, to process and analyze information for these purposes.

5. USE OF SYNTHETIC CONSCIOUSNESS

Kuttura LLC uses synthetic consciousness, meaning Kuttura LLC's artificial intelligence systems, to aggregate and analyze information in connection with the Services. A scan you submit is sent to our application host and to the model provider, xAI, so the Service can identify an aircraft. Those requests are not stored by us as a photo archive. Information processed by synthetic consciousness is handled in accordance with this Privacy Policy, including the limits on sharing described in Section 7 and the security measures described in Section 10.

6. COOKIES AND ANALYTICS

We use cookies and similar technologies to operate the Services, remember your preferences, and understand how the Services are used. You can control cookies through your browser settings. Disabling cookies may limit some features of the Services.

7. HOW WE SHARE INFORMATION

Kuttura LLC does not sell your personal information. We share personal information only (a) with the service providers below, who may use it only to provide their services to us; (b) when required by law, subpoena, court order, or other legal process; (c) to protect the rights, property, or safety of Kuttura LLC, our users, or others; and (d) in connection with a merger, acquisition, or sale of assets, subject to this Policy.

• Stripe, Inc. processes Expert subscription payments. Stripe receives the payment method you enter, the amount, and the billing period, and returns to us a customer identifier, a subscription identifier, and the status of the payment. Card numbers stay with Stripe. Stripe's privacy policy is at https://stripe.com/privacy.
• Vercel, Inc. hosts the VACR application. A request to the app passes through Vercel, which may process your IP address, browser details, and request time to deliver and protect the site.
• Neon (Neon, Inc. and its database affiliates) stores our application database. That database holds account records, license and seat records, login records, signup and admin logs, and the Stripe identifiers and subscription dates described above. Scan photographs are not stored in that database.
• GitHub, Inc. stores our source code and release history so we can publish updates. Your account, photographs, identification history, and payment card data are not stored in GitHub.
• Resend delivers account email, such as a welcome letter or a notice about your request. Those messages include your name, email address, and username.
• xAI processes a scan you submit, as described in Section 5, to return an identification.

8. INFORMATION STORED ON YOUR DEVICE

If you open VACR in a browser, or from an icon on your phone's home screen, identification history and related notes are stored in that device's local storage. Those logs stay on the device. We do not upload them to our database as a history file. They remain available the next time you open the home screen app on that same device, until you clear the site's data, remove the home screen app, or the phone reclaims storage. A home screen install uses the browser's storage for this site. It is not a separate copy in a native app folder, and another phone or browser will not have those logs.

9. DATA RETENTION

We retain personal information only as long as necessary for the purposes described in this Policy, or as required by law, including account and subscription records needed to show your license, renewals, and an expiration date. When information is no longer needed, we delete or anonymize it. Device logs in Section 8 remain only on your device.

10. DATA SECURITY

We use reasonable administrative, technical, and physical safeguards to protect personal information. Passwords are stored as hashes. Payment card numbers are handled by Stripe, not stored by us. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. YOUR CHOICES AND RIGHTS

You may request to access, correct, or delete your personal information, and you may opt out of non-essential communications at any time. You can turn off automatic renewal in the app under License. You can stop a future charge by canceling before the period ends. To make a privacy request, contact us as described in Section 15. We may need to verify your identity before responding.

12. CALIFORNIA PRIVACY RIGHTS

If you are a California resident, the California Consumer Privacy Act (CCPA), as amended, may give you the right to know what personal information we collect, use, and disclose; to request deletion or correction of your personal information; to opt out of the sale or sharing of personal information; and to not be discriminated against for exercising these rights. Kuttura LLC does not sell or share personal information for cross-context behavioral advertising. Residents of other states with consumer privacy laws may have similar rights, and we will honor requests as required by applicable law.

13. CHILDREN'S PRIVACY

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected such information, we will delete it promptly.

14. CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time. If we make changes, we will update the Effective Date above and, where appropriate, notify you by email or through the Services.
